SURVEY-DATA Terms & Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE.

By accessing and using this website in any way, including without limitation, browsing the website, using any information, using any content, using any services, downloading any material and/or placing an order for product or services, you agree to and are bound by the terms and conditions of use described in this document. If you do not agree to be legally bound by ALL the following terms, please do not access and/or use this website.

The Terms of Conditions of Use are entered into between DeBoyce Limited and you. If you are using the website on behalf of your employer, you represent that you are authorised to accept these Terms of Use on behalf of your employer.

Usage Conditions

You agree to use this site only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any Third Party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person and the transmission of obscene or offensive content or disruption of normal flow of dialogue within this site.

All the material on this site can only be used for your own personal use. You may not copy, reproduce, republish, download, post, transmit or modify the site without prior permission.

Confidentiality

All data collected under the questionnaires created on this website will be held for the sole purpose of the survey creators use or for the use of his servants or his agents use. Under no circumstance will the information identifying a Respondent, in a questionnaire, held on this site, be disclosed by Survey-data or DeBoyce Limited or it's employees.

It is the sole responsibility of the Users of survey-data to ensure confidentiality is maintained for all Respondents as required under the Data Protection Act 1998. DeBoyce Limited will not be held liable for any Users failures in complying with the Data Protection Act 1998 or breaches in confidentiality to their Respondents.

The users of the survey-data website are required to follow the ethical norms carried by survey research. This means that you should encourage people to respond to your surveys but do not pressurize them in an offensive way. It is also a requirement that you do your utmost best to ensure confidentiality. This means that you produce your results in aggregate, that is, for the sample as a whole or for sub-groups within the sample, rather than in a way that an individual’s response might be identified.

Confidentiality means that you are able to associate responses with particular people, but you DO NOT.

Users Responsibilities under the Data Protection Act 1998

It is the sole responsibility of the User to ensure that they fully comply with The Data Protection Act 1998. Depending upon the Data collected through the Users research and the subsequent use of that Data will depend upon whether the Survey-Data User will have to Notify with the Information Commissioner. If you are unsure of your position please contact the Information Commissioner’s notification Department at http://www.informationcommissioner.gov.uk. Whether you have to notify or not, it is the responsibility of all Survey-data Users to follow the principles of the Data Protection Act 1998, which set out the rules of good information handling practice and are laid down in the Act. Full details of these enforceable principles and help regarding your obligations can be found at the Information Commissioner’s website http://www.informationcommissioner.gov.uk.

Pre contract

Registered Users can create and maintain an unlimited number of surveys on the Survey-Data website. There is no restriction to the number of questions you can ask in any survey. Users will have full access to all the design elements including the facility to import logos and images to enhance the visual appearance of your survey. Additionally, the Users will be able to assign personnel access to their surveys to either help design the survey or as survey interviewers or to have access to the data collected for the Survey. The Users will also be able to pilot or test the Survey before it goes live to their target audience. The only restriction will be that Survey-data will only allow the Users to record 10 records whilst the survey’s status is still in ‘design’.

When the User is entirely happy with the structure and wording of the survey, they can set the survey to LIVE and purchase the survey licence.

Purchasing the survey licence

Commencement of the contract is the date that the survey is set LIVE. When the User sets the survey to go live, the User is asked to confirm their decision and to accept these Terms and Conditions. On acceptance of the Terms and Conditions and payment is made for the survey licence, a contract is entered into between the User and DeBoyce Limited and it is NOT possible for the User to give notice to terminate.

Please ensure you DO NOT set your survey LIVE and purchase the survey licence unless you want to be bound by these Terms and Conditions.

The survey licence enables the User to conduct and manage the LIVE online Survey created on the Survey-data site for the period up to a maximum of 90 days from the commencement of the contract. It is possible for the User to purchase an extension to the survey licence if they want the survey to run longer than 90 days.

During this period Survey-data will collect and store all the information provided by the User’s Respondents in response to the Survey. The User will be able to collect the data supplied by their Respondents at any time during this period and up to 12 months after the completion of the survey.

Payment for the Service

Once the User has confirmed acceptance of these Terms and Conditions the User will be asked to purchase the survey licence. Payment can be made using credit cards or debit cards using the Worldpay online secure server payment facility.

The Cost of the survey licence

The cost of the survey licence is subject to the taxes imposed by the UK government. By entering into the contract with DeBoyce Limited the User agrees to pay all the charges arising under this agreement, including any taxes imposed by any governing body.

Refund Policy

Once the User has entered into the Contract with DeBoyce Limited, pursuant to The Consumer Protection (Distance Selling) Regulations 2000 13 (1)(c) the User will NOT have the right to cancel the contract by giving notice of cancellation.

However, if Survey-data is unable to perform the contact because the service ordered is not available and there is no alternative substitute service, DeBoyce Limited will reimburse any sum paid by or on behalf of the User under or in relation to the contract to the person by whom it was made, pursuant to The Consumer Protection (Distance Selling) Regulations 2000 Regulation 19.

Modifications to the Terms and Conditions

DeBoyce Limited reserve the right, at DeBoyce Limited's sole discretion, to change, modify, update, add or remove portions of the Terms and Conditions of use at any time without notice to you. Please periodically check these Terms of Use for Changes. Your continued use of this website following the posting of changes to the Terms and Conditions of Use will constitute your acceptance of those changes and Users will be bound by the Agreement as amended.

Disclaimer of Warranties

In no event will DeBoyce Limited be liable for any damages including, without limitation, in direct or consequential damages, or any damages whatsoever arising from use or loss of use, data or profits, whether in action of contact, negligence or other tortious action, arising out of or in connection with the use of the site. DeBoyce Limited does not warrant that the functions contained in the material contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the materials. The names, images and logos identifying DeBoyce Ltd, Survey-data or third parties and their products and services are proprietary marks of DeBoyce Ltd and/or third parties. Nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any licence or right under any trade mark or patent of DeBoyce Limited, or any other third party.

Governing Law

These terms and conditions are governed by and construed in accordance with the Laws of England and Wales. Any disputes or matters arising in connections with or from the site or the Terms and Conditions shall be determined by the exclusive jurisdiction of the English Courts.

If these terms and conditions are not acceptable to you in full, you do not have permission to access the contents of this website and should cease using this site immediately.
